Welcome to Ceerly (“Service”), a divination service provided through our website (ceerly.com) and mobile applications. By accessing or using our Service, you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.

2. Acceptance of Terms

By creating an account, downloading our application, or using our Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our Service.

3. Service Description

Ceerly provides divination services for entertainment and self-reflection purposes only. Our psychic readings, predictions, and insights are not intended to replace professional advice of any kind, including but not limited to medical, legal, financial, or psychological advice.

4. Eligibility

You must be at least 18 years old to use our Service. By using Ceerly, you represent and warrant that you meet this requirement. If you are under 18, you may only use the Service with active involvement and consent of a parent or guardian.

5. Account Registration

5.1 Account Creation

To access certain features, you may need to register for an account. You agree to provide accurate, current, and complete information during registration and update it as necessary.

5.2 Account Security

You are responsible for safeguarding your password and for all activities under your account. You must notify Ceerly immediately of any unauthorized use.

6. User Conduct

When using our Service, you agree not to:

  • Use the Service for any unlawful purpose.
  • Probe, scan, or test system vulnerabilities.
  • Upload or transmit viruses, malware, or malicious code.
  • Impersonate another person or entity.
  • Interfere with or disrupt the Service.
  • Collect or harvest information without permission.
  • Send spam or unsolicited communications.

7. Content and Intellectual Property

7.1 User Content

You retain ownership of any content you submit (“User Content”). By submitting, you grant Ceerly a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for providing and improving the Service.

7.2 Intellectual Property

All Service content, features, and functionality (including text, graphics, logos, icons, software) are the exclusive property of Ceerly and protected by intellectual property laws. Unauthorized use is strictly prohibited.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy. By using the Service, you consent to the collection and use of your information as described therein.

9. Subscriptions and Payments

9.1 Subscription Services

Certain features may require a paid subscription. By subscribing, you agree to pay all applicable fees.

9.2 Payment Processing

Payments are handled by third-party payment processors (e.g., Apple, Google, Stripe). You agree to comply with their terms.

9.3 Cancellation & Refunds

  • iOS Users: Cancel via your Apple App Store subscriptions.
  • Android Users: Cancel via your Google Play subscriptions.
  • Web Users: Email us at support@ceerly.com with your cancellation request. We require up to 72 hours to process cancellations.

No Refunds: Once payment is processed, it is non-refundable. You acknowledge that by subscribing, Ceerly immediately allocates computing resources and inference capacity specific to your request, which cannot be reversed.

10. Disclaimers

10.1 Service Provided “As Is”

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied.

10.2 Divination Disclaimer

Readings are for entertainment only. Accuracy is not guaranteed. You are solely responsible for decisions made based on the Service.

11. Limitation of Liability

To the maximum extent permitted by law, Ceerly, its officers, employees, or affiliates shall not be liable for:

  • Any indirect, incidental, consequential, or punitive damages;
  • Loss of profits, revenue, data, or goodwill;
  • Any reliance placed on divination results;
  • Service interruptions, errors, or delays.

If liability cannot be excluded by law, Ceerly’s total liability shall not exceed the amount paid by you in the last one (1) month of subscription.

12. Indemnification

You agree to indemnify and hold Ceerly, its officers, directors, employees, and agents harmless against any claims, disputes, damages, or expenses (including reasonable legal fees) arising from your use of the Service.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notice. Continued use of the Service after changes constitutes acceptance.

14. Termination

We may suspend or terminate your account without prior notice if you breach these Terms. No refunds will be issued upon termination.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Australia, Australia, without regard to conflicts of law principles.

16. Dispute Resolution

Any dispute shall be resolved through binding arbitration under the rules of the Australian Centre for International Commercial Arbitration (ACICA). The venue shall be Adelaide, South Australia. Class actions are expressly waived.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and Ceerly, superseding all prior agreements.
